These Terms of Service govern your use of the Daffodil Road Yarn & Fibre Co. website and your purchase of products from us.

By accessing or using our website, placing an order, or purchasing products from us, you agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping Policy and Refund & Exchange Policy.

Please read these Terms carefully before placing an order.


ABOUT US


Daffodil Road Yarn & Fibre Co. is an Australian yarn and fibre business specialising in hand-dyed yarn, fibre, knitting and crochet products, yarn kits, accessories and related products.

Throughout these Terms, “Daffodil Road Yarn & Fibre Co.”, “Daffodil Road”, “we”, “us” and “our” means Daffodil Road Yarn & Fibre Co.

“You” and “your” means the person accessing our website or purchasing our products.


ACCEPTANCE OF THESE TERMS


By using our website or purchasing from us, you confirm that:

  • you have read and understood these Terms;
  • you agree to be bound by these Terms;
  • the information you provide to us is accurate and complete; and
  • you are legally capable of entering into a binding agreement.

If you do not agree with these Terms, please do not use our website or place an order.

We reserve the right to update these Terms from time to time. The version applicable to your purchase will generally be the version in effect at the time your order is placed.


PRODUCTS AND PRODUCT INFORMATION


We take considerable care in describing and photographing our products.

However, many of our products are handmade, hand-dyed or produced from natural fibres. As a result, there may be variations between individual skeins, batches and colourways.


Product photographs are intended as a representation of the product. 

Actual colours may vary depending on:

  • your device or monitor settings;
  • lighting conditions;
  • photography conditions;
  • the natural characteristics of the fibre; and
  • the hand-dyeing process.

We cannot guarantee that the colour displayed on your device will be an exact representation of the physical yarn.

Descriptions of fibre content, weight, meterage, gauge, care requirements and other product characteristics are provided in good faith and are intended as a guide.

Where a product is described as OOAK (One of a Kind), the colourway is intentionally unique and is not reproducible. Please ensure you have enough yarn before commencing a project using OOAK colours.


HAND-DYED YARN AND DYE LOTS


Hand-dyed yarn is inherently variable.

Even where the same colour recipe is used, subsequent dye lots may differ due to differences in:

  • fibre;
  • yarn base;
  • dye absorption;
  • water;
  • temperature;
  • batch size; and
  • the individual dyeing process.

For projects requiring multiple skeins, we strongly recommend purchasing sufficient yarn from the same dye lot at the time of purchase.


Where multiple skeins of the same colourway are purchased in the same order, we will endeavour to provide skeins from the same dye lot where reasonably possible. However, this cannot always be guaranteed.


We recommend alternating skeins when working with multiple skeins where appropriate to minimise the visual impact of natural dye-lot variation.

Minor differences between skeins of hand-dyed yarn are not necessarily considered a fault.


NATURAL FIBRES


Our products may contain natural fibres including wool, alpaca, silk, mohair and other animal or plant fibres.


Natural fibres can vary in:

  • texture;
  • colour;
  • staple length;
  • softness;
  • thickness;
  • crimp;
  • strength; and
  • appearance.

These characteristics are inherent to natural fibre products and are not necessarily defects.


Some yarn bases may contain natural characteristics such as slubs, neps, variation in thickness or other textural features. Where these characteristics are part of the intended construction of the yarn, they are not considered manufacturing faults.


6. PRODUCT AVAILABILITY


All products are subject to availability.

We make reasonable efforts to ensure that website stock levels are accurate. However, due to the nature of small-batch and handmade production, there may occasionally be circumstances where an item becomes unavailable after an order is placed.

If we are unable to fulfil an order, or part of an order, we will contact you and may offer:

  • an alternative product;
  • a replacement colourway where appropriate;
  • a refund for the unavailable product; or
  • another mutually agreed solution.


We reserve the right to correct genuine pricing, description, stock or website errors.


PRICING AND PAYMENT


All prices displayed on our Australian website are in Australian dollars (AUD) unless otherwise stated.

Prices may change without notice, but changes will not affect orders that have already been accepted and paid for.

Payment must be successfully processed before an order is dispatched.

We reserve the right to cancel an order where there has been an obvious pricing, product or website error. If your payment has already been processed, we will refund the amount paid for the affected product.


ORDER ACCEPTANCE


Submitting an order through our website constitutes an offer to purchase the selected products.


An order confirmation confirms that we have received your order. It does not necessarily constitute acceptance where we subsequently identify an issue such as stock availability, pricing or product error.


We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • there has been a genuine website or pricing error;
  • we reasonably suspect fraudulent activity;
  • an order appears to have been placed for an inappropriate or unlawful purpose; or
  • circumstances outside our reasonable control prevent fulfilment.

Where an order is cancelled after payment has been received, the affected amount will be refunded.


PRE-ORDERS


Some products may be offered as pre-orders.

Where a product is identified as a pre-order, the estimated dispatch timeframe will be provided in the product description or accompanying information.


Pre-order dates are estimates and may change due to circumstances including supplier delays, production delays, shipping delays or other circumstances outside our reasonable control.


If an order contains both in-stock products and pre-order products, the order may be held and dispatched together unless otherwise stated.

Where appropriate, we may offer the option of splitting an order into separate shipments, with any additional shipping costs payable by the customer.


YARN KITS AND PATTERNS


Yarn kits are assembled based on the requirements of the applicable project or pattern as described at the time of sale.

Unless expressly stated otherwise, the purchase of a yarn kit does not include the knitting or crochet pattern.

Patterns are generally the intellectual property of their respective designers and are subject to the designer’s own terms and conditions.


Daffodil Road Yarn & Fibre Co. does not guarantee that a customer’s finished project will match sample photographs or that the stated quantity of yarn will be sufficient where a customer’s gauge, tension, size or knitting/crochet technique differs from the specifications used for the sample.

Customers are responsible for checking pattern requirements, gauge and sizing before commencing a project.


YARN WINDING


Where we offer a yarn winding service, yarn will be wound from skein form into a cake using reasonable care.

Once yarn has been wound, it is considered prepared for use.

Customers should inspect wound yarn promptly upon receipt and contact us as soon as possible if there is a concern with the service.

Once a customer has begun using, knitting or crocheting with wound yarn, we may be unable to determine whether an issue arose during winding or through subsequent handling.

We recommend that customers inspect their yarn before commencing their project.


SHIPPING AND DELIVERY


We ship orders to the destinations and using the delivery methods available at checkout.


Estimated delivery times are provided as a guide only and are not guaranteed.

Delivery times may be affected by:

  • postal or courier delays;
  • public holidays;
  • severe weather;
  • natural disasters;
  • industrial action;
  • incorrect or incomplete addresses;
  • customs or border processing;
  • peak trading periods; or
  • other circumstances outside our reasonable control.

Customers are responsible for ensuring that their delivery address is correct at the time an order is placed.

If an order is returned to us because an incorrect or incomplete address was provided, additional postage costs may apply before the order can be resent.


INTERNATIONAL ORDERS


International customers are responsible for ensuring that the products they order may legally be imported into their country.


Customers are also responsible for any applicable:

  • customs duties;
  • import taxes;
  • GST or equivalent taxes;
  • customs processing fees; or
  • other charges imposed by the destination country.


Daffodil Road Yarn & Fibre Co. is not responsible for delays caused by customs or border authorities.


RISK IN PRODUCTS


We take reasonable care when packing orders for dispatch.

Once an order has been delivered to the address provided by the customer, responsibility for the safe handling and storage of the products passes to the customer, subject to any rights the customer has under applicable consumer law.

Customers should store yarn and fibre in a clean, dry environment away from moisture, pests and excessive heat.


RETURNS AND EXCHANGES


Our Returns & Refunds Policy forms part of these Terms of Service.

We offer exchanges in accordance with that policy, including our stated exchange period and conditions.

Nothing in our returns policy or these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.


Please inspect your order promptly upon delivery and contact us as soon as possible if:

  • the wrong product has been supplied;
  • products are missing;
  • products are damaged;
  • products have a manufacturing fault; or
  • you believe your order does not match what you purchased.

Where an incorrect product has been supplied, we will work with you to resolve the issue, which may include replacement of the incorrect product and arrangements for its return.


CHANGE OF MIND


Where permitted by law, we are not required to provide a refund or exchange simply because a customer has changed their mind.


Any discretionary change-of-mind exchange or return is subject to our current Returns & Refunds Policy.


Products returned under a discretionary change-of-mind policy may be required to be:

  • unused;
  • unwashed;
  • unaltered;
  • in original condition;
  • free from odour, pet hair and other contamination; and
  • accompanied by the original packaging where reasonably applicable.

Yarn that has been wound, cut, washed, knitted, crocheted, felted, altered or otherwise used is not eligible for a change-of-mind return or exchange.

This does not affect your rights under Australian Consumer Law.


SALE, CLEARANCE AND DISCONTINUED PRODUCTS


Sale and clearance products may be reduced because they are discontinued, end-of-line, older dye lots, sample stock, irregular stock, contain minor dye errors or otherwise identified as clearance.


Where a product is specifically identified as having a known imperfection or irregularity, that information will be provided where reasonably practicable.

Sale pricing does not remove or reduce any consumer guarantees that apply under Australian law.


All discounted sales are final and are not eligible for exchange or refund.


CARE OF YARN AND FIBRE


Customers are responsible for following the care instructions provided for the relevant yarn or fibre.


Unless otherwise stated, natural fibre products should generally be handled and hand washed according to the specific care instructions supplied for that product.


Daffodil Road Yarn & Fibre Co. is not responsible for damage caused by:

  • incorrect washing;
  • excessive heat;
  • inappropriate detergents;
  • agitation;
  • incorrect drying;
  • improper storage;
  • moth or pest damage;
  • misuse; or
  • failure to follow care instructions.


INTELLECTUAL PROPERTY


All content on our website, including but not limited to:

  • photographs;
  • product descriptions;
  • colourway names;
  • logos;
  • branding;
  • graphics;
  • written content;
  • website design;
  • original artwork; and
  • other materials,

is owned by or licensed to Daffodil Road Yarn & Fibre Co. unless otherwise stated.


You must not reproduce, copy, modify, distribute, sell, publish or commercially exploit our intellectual property without our prior written permission, except where permitted by law.


This includes reproducing our original colourway concepts, written descriptions, photography or branding for commercial purposes.

All images of sample knits or test knits are our intellectual property and must not be shared publicly without prior written permission.


CUSTOMER PHOTOGRAPHS AND CONTENT


If you voluntarily tag, mention or otherwise identify Daffodil Road Yarn & Fibre Co. in publicly available content relating to our products, you grant us permission to share that content on our social media or marketing channels where the platform’s functionality permits, provided that we reasonably attribute the content to you.

We will not claim ownership of your original content.

If you do not want us to share your content, please contact us and we will make reasonable efforts to remove it from our own channels where practicable.


REVIEWS AND CUSTOMER COMMENTS


We welcome genuine customer feedback and reviews.

Reviews and comments must not contain content that is:

  • unlawful;
  • defamatory;
  • threatening;
  • abusive;
  • discriminatory;
  • obscene;
  • misleading;
  • fraudulent;
  • deliberately deceptive; or
  • unrelated to the products or services being reviewed.

We reserve the right to remove or decline to publish content that breaches these requirements.

We do not remove genuine negative reviews merely because they are negative. However, we do ask that if you have an issue with a product or service that you get in touch with us first and allow us reasonable time to address your concerns.

  • government restrictions;
  • industrial disputes;
  • transport disruptions;
  • postal or courier failures;
  • supplier failures;
  • cyber incidents;
  • power or telecommunications failures; or

Where reasonably practicable, we will communicate with affected customers and take reasonable steps to minimise the impact.


FRAUDULENT OR ABUSIVE ACTIVITY


We reserve the right to refuse, cancel or investigate orders where we reasonably suspect:

  • payment fraud;
  • misuse of promotional codes;
  • repeated abuse of returns or refund processes;
  • fraudulent chargebacks;
  • unauthorised use of another person’s payment method;
  • false claims relating to delivery or product condition; or
  • other dishonest or abusive conduct.

Nothing in this section limits a customer’s rights under Australian Consumer Law.


DISPUTES

SEVERABILITY


If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the extent necessary, without affecting the validity of the remaining provisions.


ENTIRE AGREEMENT


These Terms, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy, constitute the terms governing your use of our website and purchase of products from Daffodil Road Yarn & Fibre Co., subject to any additional terms expressly provided for particular products or services.
